General Terms and Conditions (GTC)

1. Scope

These Terms and Conditions apply to all orders, deliveries, and services provided through the Gedenklicht online store, operated by ARSERIT GmbH.

By placing an order in the online store, the customer accepts these General Terms and Conditions in the version in effect at the time of the order.

Any terms and conditions provided by the customer shall apply only if they have been expressly accepted in writing by Gedenklicht c/o ARSERIT GmbH.

2. Offer and Conclusion of the Contract

The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By submitting the order, the customer makes a binding offer to enter into a sales contract. The contract is concluded as soon as Gedenklicht c/o ARSERIT GmbH confirms the order or ships the goods.

Gedenklicht c/o ARSERIT GmbH reserves the right to reject orders in whole or in part, particularly in the event of product unavailability, obvious pricing or product errors, or incomplete or incorrect information provided by the customer.

3. Prices

All prices are in Swiss francs (CHF), unless another currency is expressly specified.

The prices listed in the online store for individual customers include the applicable value-added tax.

Shipping costs and any additional services selected by the customer are listed separately and are visible before the order is finalized.

We reserve the right to make price changes, product line changes, and corrections to obvious errors. The price displayed at the time of the order is final.

4. Product Information

Gedenklicht c/o ARSERIT GmbH strives to provide accurate and complete product descriptions, images, technical specifications, and availability information.

Product images are intended to provide a representation that is as realistic as possible. Minor variations—particularly with regard to color, texture, packaging, or design—are possible, provided that the essential product characteristics are not affected.

Information regarding the burn time of candles is approximate. The actual burn time may be affected by factors such as temperature, weather, location, airflow, and other environmental conditions.

We reserve the right to make technical changes and improvements, provided they do not significantly impair the intended use of the product.

5. Order

Orders can be placed through the online store or via other ordering channels approved by Gedenklicht c/o ARSERIT GmbH.

The customer is required to provide complete and accurate information when placing an order.

Gedenklicht c/o ARSERIT GmbH assumes no responsibility for delays or additional costs resulting from incorrect or incomplete information provided by the customer, unless Gedenklicht is at fault.

Subsequent changes or cancellations of an order are only possible with the consent of Gedenklicht c/o ARSERIT GmbH.

6. Terms of Payment

The payment methods available in the online store are displayed during the checkout process.

Unless otherwise expressly agreed, the purchase price is due upon completion of the order.

Delivery generally takes place after payment has been successfully received or after payment has been confirmed by the selected payment service provider.

For payments by invoice, the invoice amount must be paid in full, without any deductions, within the payment period specified on the invoice.

In the event of late payment, interest at a rate of 5% per year will be charged. Reasonable reminder and collection fees may also be billed.

Gedenklicht c/o ARSERIT GmbH may withhold further deliveries until all outstanding balances have been paid in full.

7. Retention of Title

The delivered goods remain the property of Gedenklicht c/o ARSERIT GmbH until the purchase price has been paid in full, provided that a retention of title has been validly agreed upon and is permitted by law.

8. Delivery and Shipping

Deliveries are made to the shipping address provided by the customer.

The available shipping methods, delivery areas, estimated delivery times, and shipping costs are displayed in the online store or during the checkout process.

Unless a binding delivery date has been expressly agreed upon, the stated delivery times are generally non-binding estimates.

In the event of significant delivery delays, the customer will be notified whenever possible.

Partial deliveries are permitted, provided they are reasonable for the customer. The customer will not be charged any additional shipping costs resulting from a partial delivery arranged by Gedenklicht.

9. Shipping and Damage During Transport

The merchandise is carefully packaged and handed over to the shipping carrier responsible for delivery.

The customer is asked to inspect the shipment for any visible damage caused during transit upon receipt.

Any transport damage discovered must be reported to Gedenklicht c/o ARSERIT GmbH as soon as possible. Where possible, visible damage should be noted with the shipping provider at the time of delivery.

The statutory provisions regarding benefit and risk remain in effect.

10. Availability and Delivery Obstacles

If a product is unavailable after the order has been placed, Gedenklicht c/o ARSERIT GmbH will notify the customer as soon as possible.

In this case, Gedenklicht may, upon consultation, offer a substitute product, make a partial delivery, or cancel the order with respect to the products that are unavailable.

Payments already made for products that cannot be delivered and have not been replaced will be refunded.

In the event of circumstances beyond the reasonable control of Gedenklicht c/o ARSERIT GmbH—in particular, force majeure, operational disruptions, government measures, transportation problems, or significant delivery delays—delivery times may be extended accordingly.

If delivery is permanently impossible or no longer reasonable, either party may withdraw from the contract with respect to the affected products. In this case, any payments already made will be refunded.

11. Inspection of the Goods and Complaints

The customer is asked to inspect the delivered goods upon receipt to ensure they are complete, correct, and free of any visible defects.

Gedenklicht c/o ARSERIT GmbH must be notified of any obvious defects, incorrect deliveries, or incomplete deliveries within 10 days of receiving the goods, if possible.

Hidden defects must be reported as soon as possible after they are discovered.

We reserve the right to enforce statutory warranty claims.

12. Voluntary Right of Return and Exchange

Under Swiss law, there is generally no statutory right of cancellation or return for purchases made in the online store. However, Gedenklicht c/o ARSERIT GmbH voluntarily grants individual customers a 14-day right to return or exchange merchandise, effective from the date of receipt.

The merchandise must be returned within this period or brought back to our location in Bütschwil. To meet the deadline, it is sufficient to hand over the return shipment to the shipping provider in a timely manner.

It is not necessary to notify us in advance of the return.

Items must be in perfect, complete, unused, and saleable condition. Where available, the original packaging, labels, accessories, and all included components must be returned.

The customer is responsible for the costs and shipping risk associated with voluntary returns.

In the event of an incorrect shipment or a valid complaint regarding defective merchandise, Gedenklicht c/o ARSERIT GmbH will cover the necessary return shipping costs.

Once the returned merchandise has been received and inspected, the purchase price paid for the returned items will generally be refunded via the payment method used when placing the order.

The cost of the original shipment, as well as any costs for additional shipping or services, will not be refunded in the event of a voluntary return.

The following items, in particular, are excluded from the voluntary right of return and exchange:

  • items that are custom-made, personalized, or procured according to customer specifications;

  • candles that have already been used or are burned down;

  • damaged, soiled, or unsellable items;

  • Items from which labels, seals, or essential components have been removed.

This does not affect your rights regarding defective or incorrectly delivered goods.

13. Warranty

Gedenklicht c/o ARSERIT GmbH warrants, within the scope of applicable law, that the products delivered are free from defects at the time of delivery that would significantly impair their value or their suitability for their intended use.

In the event of a valid warranty claim, statutory claims may be asserted unless these Terms and Conditions contain a permissible provision to the contrary.

Gedenklicht, c/o ARSERIT GmbH, can, in particular, offer a suitable replacement.

No warranty is provided for damage or impairments caused, in particular, by:

  • improper or inappropriate use;

  • Failure to follow safety or usage instructions;

  • normal wear and tear;

  • improper storage;

  • external influences or weather conditions, unless the product has been expressly warranted for such conditions.

Any manufacturer's warranties apply in addition and are subject to the manufacturer's respective warranty terms and conditions.

14. Liability

Gedenklicht c/o ARSERIT GmbH is liable in accordance with statutory provisions for damages caused by willful misconduct or gross negligence.

To the extent permitted by law, liability for slight negligence, as well as for indirect and consequential damages, is excluded.

In particular, Gedenklicht c/o ARSERIT GmbH is not liable for damages resulting from improper use of the products or failure to follow the safety and usage instructions.

We reserve the right to apply mandatory statutory liability provisions.

15. Product Use and Safety

The customer is required to use the products as intended and in accordance with the applicable safety, usage, and care instructions.

In particular, candles and open flames must not be left burning unattended and must be used in accordance with the safety instructions provided with the product or in the online store.

To the extent permitted by law, no liability is assumed for damages resulting from improper use or failure to follow the safety instructions.

16. Data Protection

Gedenklicht c/o ARSERIT GmbH processes personal data in accordance with its Privacy Policy and applicable Swiss data protection regulations.

The current privacy policy is available in the online store.

17. Intellectual Property

The content of the online store—in particular, text, images, graphics, logos, designs, and product information—is protected by copyright or other means.

Any reproduction, modification, or distribution beyond the scope of permitted legal use is prohibited without the prior consent of Gedenklicht c/o ARSERIT GmbH.

18. Changes to the Terms and Conditions

Gedenklicht c/o ARSERIT GmbH may amend these Terms and Conditions at any time.

For each order, the version of the Terms and Conditions that was in effect at the time the contract was concluded shall apply.

19. Severability Clause

Should any provision of these Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Any invalid provision shall be replaced by the applicable statutory provisions.

20. Governing Law and Jurisdiction

The legal relationship between Gedenklicht c/o ARSERIT GmbH and the customer shall be governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods, to the extent that such exclusion is permitted.

To the extent permitted by law, the place of jurisdiction is the registered office of ARSERIT GmbH.

For consumers, the mandatory statutory jurisdictions apply.
